Gas Safety Week May be Coming to an End, but it Still Matters

This weekend may mark the end of 2017’s Gas Safety Week, but landlords must remember that gas safety still matters going forward.

Earlier this week, when Gas Safe Register’s Gas Safety Week 2017 began, we reminded all landlords of their legal obligations regarding gas safety, to ensure that you keep your tenants safe when they’re living in your properties.

Although gas safety is important all year round, Gas Safety Week is the perfect opportunity to raise awareness amongst homeowners, landlords and tenants of their responsibilities concerning gas safety.

Although Gas Safety Week comes to a close on Sunday, we are calling on all landlords to stick to the law and comply with all of the regulations regarding gas safety.

The Chief Executive of ARLA Propertymark (the Association of Residential Letting Agents), David Cox, reiterates the organisation’s support for gas safety awareness: “As Gas Safety Week draws to a close, ARLA Propertymark highlights the campaign and the importance of gas safety. Agents and landlords are legally responsible for the safety of their tenants, so it’s important they ensure that maintenance and annual safety checks on gas appliances are carried out by a Gas Safe registered engineer. In the last three years, there have been 22 deaths and nearly 1,000 gas-related injuries, and Gas Safety Week gives us an opportunity to reiterate the need for better safety measures in rental properties.

“Providing a Gas Safety Certificate to tenants is already a legal requirement for landlords, and provides peace of mind for tenants that the property and its appliances are safe. Renters shouldn’t be afraid to demand this document if they aren’t given it at the start of an agreement. It’s now time for the Government to make best practice legal, and enforce compulsory carbon monoxide alarms in every rented property. At the moment, they only need to be in rooms with solid fuel burning, but we should be doing all we can to protect tenants.”

Landlord News is proud to be working with Gas Safe Register to promote Gas Safety Week 2017, which starts today, to help fight for a gas safe nation.

Gas Safety Week is an annual safety week to raise awareness of gas safety and the importance of taking care of your gas appliances. It is co-ordinated by Gas Safe Register – the official list of gas engineers who are legally allowed to work on gas.

Landlords must understand that badly fitted and poorly serviced gas appliances can cause gas leaks, fires, explosions and carbon monoxide poisoning. Every year, thousands of people across the UK are diagnosed with carbon monoxide poisoning. It is a highly poisonous gas that can kill quickly, with no warning.

Landlords are legally responsible for the safety of their tenants. For this reason, you must make sure that a Gas Safe registered engineer conducts maintenance and annual safety checks on gas appliances in your rental properties.

Help us Fight for a Gas Safe Nation this Week

As it’s Gas Safety Week, here is a short summary of your legal duties as a landlord:

  • Pipe-work, appliances and flues provided for tenants must be maintained in a safe condition.
  • All appliances and flues provided for tenants’ use must have an annual safety check. It is important to set a reminder so that you don’t forget to arrange this.
  • An engineer registered with Gas Safe Register must carry out maintenance and annual safety checks.
  • All gas equipment (including any appliances left by a previous tenant) must be safe or otherwise removed before re-letting.
  • You must provide your tenant with a Gas Safety Record within 28 days of completing the check, or to any new tenant before they move in.
  • You must keep a copy of the Gas Safety Record for two years.

Before any gas work is undertaken, always check the engineer’s UD card and make sure that they are qualified for the work you need doing. You should also encourage your tenants to do the same.

Rogue landlord jailed for Gas Safety negligence

A private landlord from Cornwall has been hit with a 12-month prison sentence, suspended for 24 months. In addition, the rogue was fined £5,000 and told to pay costs of £5,524, after negligence towards gas appliance maintenance at his rental properties on St Thomas, Launceston.

Truro Crown Court was informed that the landlord David Bush, failed to maintain the gas appliances in two properties- both of which were not inspected by a registered Gas Safe Register engineer.

An investigation by the Health and Safety Executive also found that Bush failed to obtain a Landlord Gas Safety Record after May 2014, while the appliances in the property had not been serviced for at least 4 years.

Mr Bush was punished after pleading guilty to breaching Regulations 36 (2) (a) and 36 (3) (a) of the Gas Safety (Installation and Use) Regulations 1998 and Regulation 3 (2) of the Health and Safety at Work Act 1974.

Following the hearing, Health and Safety inspector Simon Jones, noted: ‘Mr Bush put the residents and other members of the public at risk of harm by failing to maintain gas appliances in the domestic property.’

‘Landlords must ensure they obtain a Landlord’s Gas Safety Record and maintain all gas appliances in accordance with the law.’[1]

Landlord Given Suspended Sentence for Risking Tenants’ Lives

A buy-to-let landlord in Ilfracombe, a seaside resort on the North Devon coast, has been given a suspended prison sentence for risking the lives of his tenants by conducting dangerous gas work.

Exeter Crown Court was told that, in September 2016, Allan King replaced a boiler at his rental property on Arcade Road, despite having no training in gas work and not being listed with the Gas Safe Register.

After the boiler developed faults a few weeks later, the landlord called in a gas engineer for help.

The engineer immediately recognised that the boiler was risking the tenants’ lives, and isolated it to make it safe. The Health and Safety Executive (HSE) was informed and launched an investigation.

Allan King, of Arcade Road, Ilfracombe, pleaded guilty to breaches of the Gas Safety (Installation and Use) Regulations 1998 and the Health and Safety at Work etc. Act 1974.

The landlord was sentenced to nine months’ imprisonment, suspended for 18 months, and fined £3,000. He was also ordered to pay costs totalling £12,184.14.

An HSE inspector, Simon Jones, spoke after the hearing: “Landlords have a legal duty to ensure that any gas work at their rented properties is only undertaken by a member of Gas Safe Register.

“In this case, Mr. King ignored previous warnings and undertook his own DIY gas work, for which he had neither the competence nor credentials. His actions were dangerous and put his tenants’ lives at risk.”

A private landlord with a rental property in Haverfordwest, Pembrokeshire has been prosecuted, after failing to maintain gas appliances in his rental property.

Mr Gous Ahmed was found guilty at Llanelli Magistrates Court of breaching Regulation 36 (1) of the Gas Safety (Installation and Use) Regulations 1998. As a result, he was given a fine of more than £15,000 and ordered to pay costs of £2,500.

Dangerous

The rental property in Haverfordwest was inspected by British Gas in February 2015. On this inspection, British Gas found the boiler and fire to be ‘immediately dangerous,’ with the tenants in the property at imminent risk of potential harm.

Upon further investigation, the Health and Safety Executive found that Mr Ahmed had not obtained the sufficient Landlord Gas Safety Record for his rental property.

Despite improvement enforcement action carried out by the Health and Safety Executive and a number of letters from various council officers, the landlord still failed to obtain the relevant Gas Safety Record.

After the case, Health and Safety Executive inspector Simon Breen, noted: ‘Mr Ahmed put the residents and other members of the public at risk of harm by failing to maintain gas appliances in the domestic property. Landlords and duty holder must ensure they obtain a Landlord Gas Safety Record and they maintain all gas appliances in accordance with the law.’[1]

More than half of UK landlords have taken action on the fire safety of their rental properties following the terrible Grenfell Tower fire, shows a new survey.

A study of 500 private landlords found that a third (32%) had checked their fire alarms, while 15% had instructed a professional to carry out a fire risk assessment in the wake of the tragedy.

Landlords of Houses in Multiple Occupation (HMOs) and flats were among the most proactive over the past four weeks, with fire alarm checks being conducted in 50% of HMOs and 35% of flats. These properties also saw a higher than average number of professional checks, with 39% of HMOs and 22% of flats being visited for assessments.

Other measures taken by landlords included checking construction materials of their properties and contacting the freeholder regarding fire safety checks. 17% of landlords also said that they had installed a carbon monoxide alarm.

The survey, carried out on behalf of Simple Landlords Insurance, was conducted a month after the Grenfell Tower fire in North Kensington.

Perhaps unsurprisingly, landlords in London were the most responsive of all the geographical regions polled. Some 72% reported having taken at least one action following the disaster, compared with just a third in Wales.

However, one area of concern uncovered by the research was gas safety. While every landlord questioned said that they had conducted a gas safety inspection on their property, just 83% said that it had occurred within the last 12 months.

Landlords are legally required to have a Gas Safe-registered engineer check all gas appliances in their properties at least once a year. The majority of the remaining landlords (11%) fell between the 12 and 18-month bracket, while an alarming 4% said that it had been more than three years since their last gas safety check.

The Head of Operations at Simple Landlords Insurance, Alex Huntley, comments on the study: “Fire safety is clearly on the agenda for landlords in the UK, with a little over half taking positive action in the last month alone. Landlords have a legal obligation to protect tenants under fire safety regulations, particularly those with large or shared properties.

“Gas safety is also of paramount importance and, although on the whole the survey has shown a positive and responsible response from landlords, they must understand their obligations; fire and gas safety must never be left to chance.”

The findings arrive as the Residential Landlords Association (RLA) calls for change in fire safety guidance.
